St. Maarten – Charlie Mileilis got lucky yesterday when the Court in First Instance sentenced him for robbing a 72-year-old tourist of his gold chain on March 5. Instead of sending him to jail for two years, Judge mr. M. Keppels sentenced the 18-year-old to 24 months conditional with 3 years probation. He will also have to do the maximum of 240 hours of community service.

Mileilis will also face a request by the public prosecutor to execute the conditional part of a jail sentence he received in February of last year for attempted manslaughter on Gerald Junior Burnett on October 18, 2009. The court sentenced the defendant to 370 days of which 240 days were suspended. He now may have to serve the suspended part of this sentence in the near future.

The teenager told the court that he had grabbed the chain off the old man “because he liked the chain.” He admitted, “I shouldn’t do that,” and said that he committed the robbery alone. He was arrested on the day of the robbery and released on March 24, after having spent 19 days in a police cell.

Prosecutor mr. M.L.P. Ridderbeks considered the charge proven; Mileilis had been caught practically red handed, the victim recognized him and he admitted to the robbery in court.

“He talks with ease about this robbery,” the prosecutor remarked, “He is not a first offender, and he is no longer a minor. He ought to go to jail for two years for this robbery.”

But given the situation at the Pointe Blanche prison, Ridderbeks said that she was prepared to give the youngster one last chance, by imposing a suspended prison sentence, combined with the maximum community service.

Mileilis’ attorney mr. S.R. Bommel pointed out that her client had immediately confessed. “He knows that what he did was wrong. He is going to school and he is helping a neighbor to build a house.”

Judge Keppels followed the prosecutor’s demand and added a stern warning of her own. “This is your last chance to stay out of prison.”
