Rapist sentenced to 44 months

St. Maarten – The Court in First Instance sentenced Sheldon Fernando Harris to 44 months of imprisonment for raping a 12-year-old girl on August 23 of last year in her own home in Hope Estate. Of the sentence, 12 months are suspended and the court imposed a probation period of 3 years.

The now 30-year-old rapist forced his way into the home after the girl had opened to answer a knock on the door.  She recognized him as a neighbor who lived in an apartment beneath hers.

The man overwhelmed the young girl and raped her. The victim gave a detailed report of what happened and her story is supported by forensic evidence.

The court rejected the rapist’s defense that he could not have carried the girl to a couch as she claimed because she was heavier than him. The court concluded that he led the girl to the couch. It also rejected the story that a neighbor could confirm his version of the truth, because this neighbor never materialized.

The girl made several attempts to push her attacker away; she also told him to stop, but to no avail.

“The defendant, 30 years of age, has raped a 12-year-old girl. By doing this he has violated the girl’s physical integrity. The defendant only had the satisfaction of his feelings of lust in mind and never considered the serious consequences of his actions for his victim,” the court wrote in its ruling.
