St. Maarten / 7 Sept. 2012 – The Court in First Instance sentenced Eliseo Calcano-Galcia to 12 months imprisonment for sexual assault on an 11-year-old girl and firearm possession.
The 50-year-old defendant who goes by the nickname Calki told police that he is a singer and a guitar player. He had lured the young girl to his house with the promise that he would teach her to play the guitar and to make her a star. But after one lesson the contacts changed into something totally different whereby the defendant touched the girl in an inappropriate way, showed her a handgun and a hunting rifle, let her fire one of the weapons and gave her money. He instructed the girl not to talk about their contacts with her mother, threatening to kill the mother and the girl’s sister if she dared to open her mouth. The defendant maintained contacts with the girl between January 1 and April 4 of this year.
Judge Tamara Tijhuis rejected attorney Geert Hatzmann’s argument that his client suffered from a Peter pan-syndrome, that he experiences the world around him differently from others, that he is in a way still a child himself and that he did not have sexual intention in his contacts with the girl.
Judge Tijhuis ruled that the defendant’s acts were of a sexual nature and that they violated the social-ethical standard. “The way he forced the girl to undergo these actions show sufficiently that the defendant was aware that his actions are socially unacceptable.”
The judge considered that the defendant had “most probably negatively affected the girl’s normal and healthy development during a vulnerable period in her life” with his actions.
The defendant showed the girl firearms, let her even fire one and told her that the weapons are fit to kill people
