Ombudsman office announces petition to Constitutional Court

POSTED: 01/24/13 10:32 AM

St. Maarten – The Ombudsman has announced a press conference for next week Tuesday where the office will announce its first petition to the Constitutional Court. While the invitation for the press conference does not reveal any details about the petition it stands to reason to assume that the Ombudsman will send the new penal code that was signed into law by the governor in December to this court for constitutional review.

The penal code was approved by the parliament on May 25 of last year. There are two debatable elements: the removal of an article that guarantees inmates with a life sentence to a review of their punishment after 20 years, and an amendment to the article that prohibits cruelty against animals. The amendment makes organized cock fights legal.
