Man sentenced to 30 months for attempted manslaughter

St. Maarten – The Court in First Instance sentenced Sugal Angel Gregorio Canelo Rodriguez yesterday to 30 months of imprisonment for attempted manslaughter on a man on August 26, 2012, and for shattering the window of a house on January 20 of this year. Of the sentence, 12 months are conditional and the court imposed 3 years of probation plus the obligation to abide by instructions from the Rehabilitation Bureau that has advised the court to have the defendant treated for his alcohol problem.

Rodriguez confessed in court to shattering the window in January. On August 26 of last year he was in the El Patio de Esperanza bar together with a cousin. His brother Carlos got into an argument with the later victim of a stabbing. Carlos left the bar and, according to his girlfriend, said at home that he was going to kill the later victim. Rodriguez attempted in vain to convince his brother to stay home.

Back in the bar, the victim threw a bottle at Carlos. A witness told the victim to calm down because he had the situation under control. The same witness also saw that the 25-year-old Rodriguez had a knife in his hand and attacked his victim, who defended himself by throwing bottles and chairs. The witness saw how Rodriguez made a stabbing movement in the direction of the victim. After that, he ran away.

Rodriguez claimed during the court hearing on May 22, that the victim, who is a large man, came towards him. After he stabbed him, he jumped over a table and ran.

The medical report shows that the victim had three stab wounds. Two of them were deep and in the upper belly. According to the report, these stab wounds could have been fatal.

The court dismissed the defense argument of self-defense. One witness called out to Rodriguez to leave the bar before he found the knife. “The defendant could have and should have chosen an alternative way to defend himself,” the court ruled.

The court considered that the victim spent time on the intensive care unit in the hospital and that he still suffers consequences of the stabbing.
