Apparently the message is not entirely clear yet to the Justice Ministry, or at least to its Immigration and Naturalization Service. While Minister Duncan has resigned to a court ruling from September 11 that basically reconfirms that American citizens have the same rights in St. Maarten as European Dutch citizens, Americans are still pressed for additional requirements like work permits or for proof of investment in their company.

The Dutch-American Friendship Treaty makes perfectly clear that Americans have equal rights – a position that has been confirmed numerous times in court.

If this is a communication hiccup between the minister and his Immigration and Naturalization Service, the mistake is easily corrected. If there is something else going on, parties will most likely meet in court again one day.
