48 Months for attempted manslaughter

St. Maarten – For attempted manslaughter on his neighbor’s boyfriend, the Court in First Instance sentenced Siegerd Basilio Leonora to 48 months imprisonment; of the sentence, 12 months are suspended. The court imposed 2 years of probation. At the trial on January 16, prosecutor Dounia Benammar demanded 4 years against the 50-year-old defendant.

On October 10 of last year, the victim approached his girlfriend’s house on Salt Rock Road. Leonora looked out of his window and started an argument with him. The victim walked away and when he came back later to go to his girlfriend, Leonora was waiting for him with a silver-colored gun in his hand. He shot the victim in his groin.

The court rejected attorney Janna Westra’s position that her client had not had the intention to kill the victim because he consciously had pointed the gun downwards and that he had aimed for the man’s feet. The court noted that the defendant told the court at the trial that he had aimed for his victim’s legs, and that he had fired his shot from close range.

The court dismissed as implausible the defendant’s statement that the victim had come towards him aggressively and that he had feared for his life. To police officers, Leonora said that the victim had walked towards him, saying do what you have to do. He claimed that he felt threatened by this remark and that he had fired a shot in self-defense. The court also dismissed this argument.

Leonora was also sentenced for firearm possession.
